Report on the Right to Liberty and Security of Person and Freedom of Expression presented to the Judges in Mostar

The Constitutional Court of Bosnia and Herzegovina presented the Report „Case Law of Bosnia and Herzegovina Courts on the Right to Liberty and Security of Person and Freedom of Expression“  to the judges of the Municipal and Cantonal Court in Mostar.

President of the Constitutional Court of Bosnia and Herzegovina Mato Tadić and Registrar of the Constitutional Court Zvonko Mijan presented the Report on 6 September in Mostar.

„One of the key standards in assessing democratic arrangement of the society (state) is a degree of freedom of expression and the extent of the state’s interference with the restrictions of freedom of expression. There is no pluralism of opinions without freedom of expression while there is a political conformism and authoritarian regime without pluralism of opinions. This inhibits development of democracy, “ said President Tadić in his introduction.

The Report on the Right to Liberty and Security of Person and Freedom of Expression was compiled by the Constitutional Court of Bosnia and Herzegovina and AIRE Centre Western Balkans Programme.

In a simple and practical way, the Report presents the relevant decisions of the courts and principles of interpretation of norms in important domains of the European Convention on Human Rights. Those are the protection of the right under Article 5 (the right to liberty and security of person) and protection of the right under Article 10 (the right to freedom of expression).

Mr. Zoran Krtalić, President of the Cantonal Court in Mostar expressed his pleasure for having the representatives of the Constitutional Court of Bosnia and Herzegovina hold the presentation on this topic and present the Report.

The Report was presented to the judges of the Appellate and Basic Court in Brčko District and judges of the Cantonal Court in Sarajevo. The Report will also be presented to the judges of the County and Basic Court in Banja Luka and judges of Cantonal and Municipal Court in Tuzla.
