The Constitutional Court of BiH, in cooperation with the German Foundation for International Legal Cooperation – IRZ held today the Regional Conference „Decisions of the European Court of Human Rights and their Impact on the Standards of the National Constitutional Courts“.
The presidents and judges of the constitutional courts of Bosnia and Herzegovina, Montenegro, Croatia, Macedonia, and Serbia, the European Court of Human Rights as well as the representatives and legal experts of the German Foundation for International Legal Cooperation took active part in the work of the Conference.
International multilateral and bilateral cooperation, international conferences, professional and scientific gatherings present an opportunity and method in which the constitutional courts are able to promote their doctrine, experience and case-law especially in the field of the rule of law, protection and promotion of human rights and fundamental freedoms. In this context, an emphasis has been made on the exchange of experiences, views and case-law on the application of the law as well as establishing the professional cooperation in regards to other issues of common interest and value for the constitutional courts in the region in which the constitutional judiciary shares common beginnings and foundations.
In 2003, the Constitutional Court of Bosnia and Herzegovina raised this initiative by which regular meetings of the constitutional courts of the region would be held.
The aim of this initiative is to exchange experiences, views and case-law on the application of law in terms of the rule of law, protection and protection of the human rights and fundamental freedoms as well as to establish a professional cooperation in regards to other issues of common interest and value for the constitutional courts of the countries in transition. The initiative was accepted by the constitutional courts of the countries of the region and now has become a tradition where the regional conference/round tables are being held regularly, each time on a different topic of common interest.
The today’s Conference, with a great number of presented notable papers on the topic of the Conference and discussions that ensued, has enlightened the issue of the impact of the decisions of the European Court of Human Rights on the case-law and standards of the national constitutional courts in the region from the different aspects but with an attempt to establish a doctrinal approach to this extremely important issue which will represent a contribution to securing a full protection of human rights and fundamental freedoms to every citizen.
That is surely another significant contribution to the jurisprudence and doctrine of the constitutional courts of the region in terms of the harmonisation of the standards of implementation of the decisions of the European Court.
