Pursuant to Article 64(2) of the Rules of the Constitutional Court of Bosnia and Herzegovina, Mr. Mirsad Ćeman, President of the Constitutional Court of BiH, today adopted a decision granting a request for an interim measure in the case no. U-28/25. The applicants in this case -- fourteen members of the House of Representatives of the Parliamentary Assembly of BiH, lodged a request for review of constitutionality. They requested deciding a dispute between Bosnia and Herzegovina and the Entity of the Republika Srpska in connection with the Conclusions (Conclusion) of the National Assembly of the Republika Srpska (RS National Assembly) with respect to the Information related to the Decision of the Central Election Commission of BiH (CEC BiH) on the Termination of the Mandate of the President of the Republika Srpska Milorad Dodik. The Conclusions were adopted by the RS National Assembly at its 24th special session held on 22 August 2025. The applicants also requested from the Constitutional Court to adopt an interim measure.  

By its decision on an interim measure, the Constitutional Court temporarily rendered ineffective items 6, 7, and 8 of the Conclusions of the RS National Assembly adopted in connection with the Information regarding the decision of the Central Election Commission of Bosnia and Herzegovina on the termination of the mandate of the President of the Republika Srpska, Milorad Dodik. The RS National Assembly adopted the Conclusions at its 24th special session held on 22 August 2025.

The Constitutional Court also decided that, pending a final decision of the Constitutional Court of Bosnia and Herzegovina on the submitted request for the review of the constitutionality of the acts, all acts adopted on the basis of items 6, 7, and 8 of the Conclusions shall be temporarily rendered ineffective. Furthermore, all legislative, executive, and judicial institutions in the Republika Srpska, as well as all official or responsible persons within those RS institutions or within local self-government units or any bodies of local self-government units, as well as official or responsible persons from the Republika Srpska performing duties in the institutions of Bosnia and Herzegovina, shall be prohibited from undertaking any actions on the basis of items 6, 7, and 8 of the Conclusions.

The Constitutional Court recalls that the decision on the interim measure in no way prejudges the decision on the admissibility or the merits of the submitted request.
