Judge of the Constitutional Court of Bosnia and Herzegovina, Prof. Dr. Larisa Velić, and Head of the Constitutional Case-Law Section, Ermina Dumanjić, attended an international conference on the topic The Future of the “Marketplace of Ideas” Amid the Rise of the Internet, Fake News, and AI: Challenges for Constitutional Courts. The conference was held on 24 April 2026, in Chișinău, in the context of the Republic of Moldova chairing the Committee of Ministers of the Council of Europe, with the support of the Council of Europe.
The conference addressed the role of courts in an era marked by the strong expansion of the internet, the emergence and spread of fake news, and the rapid advancement of artificial intelligence.
As part of the professional discussions, the conference raised numerous issues of great importance for the future of democratic societies. Consideration was given to how pluralism of ideas can be preserved in the online space, where the boundaries of acceptable regulation of digital platforms lie, and how to achieve a fair balance between the fundamental right to freedom of expression and the necessity of combating disinformation and harmful forms of speech.
Special emphasis was placed on the role of constitutional courts in the public space, which is increasingly being shaped by new technologies. One of the primary goals of the conference was indeed to encourage deep and well-argued exchanges of views on the challenges that digital transformation imposes to constitutional democracy and the rule of law.
