134th session of the Grand Chamber

The Constitutional Court of Bosnia and Herzegovina has held today its 134th ordinary session of the Grand Chamber.

Of decisions it adopted today, for illustration, the Constitutional Court has singled out the following:

AP 3166/20 – The Constitutional Court concluded that there is a violation of the appellant’s right to fair trial when regular courts failed to base their decisions on the provisions of the Law on Protection of Population from the Infectious Diseases of F BiH in case of act of committing a minor offence arising under Article 54 of that Law. Offence concerns a failure to act according to the orders on ban on movement.

AP 1805/21 – The Constitutional Court, inter alia, concluded that there is no violation of the appellant’s right to respect for family life. It is established that the challenged decision of the regular court ordering the appellant (mother of underage child) to surrender a child to the appellant (father of underage child) in the last place of residence of the child, is based on the provisions of Article 12 and 13 of the European Convention on the Civil Aspects of International Child Abduction.

All decisions adopted at today’s session will be delivered to the appellants within one month and published at the earliest possible date on the website of the Constitutional Court of Bosnia and Herzegovina.
