The 44th session of the Grand Chamber

On 26 October 2016 the Constitutional Court of BiH held its regular 44th session of the Grand Chamber.

The Constitutional Court, inter alia, considered a large number of appeals for alleged violations of the appellants’ constitutional rights infringed by ordinary courts.

 

A regards the cases where the Court established the violation of the rights to a fair trial, the competent authorities were ordered to urgently complete the proceedings and, within the time limit of three months, inform the Court accordingly.

 

The Court dismissed the appeals that were manifestly ill-founded and inadmissible and in respect of which it established that the appellants’ claims were not justified, which means that the facts presented to the Court by the appellants could in no way justify the appellant’s claim that there was a violation of his rights safeguarded under the Constitution and that the parties to the proceedings do not bear the consequences of the alleged violation of the rights safeguarded under the Constitution.

 

The Constitutional Court, inter alia, considered the Report on enforcement of decisions of the Constitutional Court of Bosnia and Herzegovina with special attention given to the period from April 2015 to March 2016 and Report on cases in respect to which rulings on non-enforcement of the decision of the Constitutional Court of BiH were adopted.

 

 All decisions taken at the session are to be delivered to the appellants within a time-limit of one month and posted on the official website of the Constitutional Court of Bosnia and Herzegovina.
