The Constitutional Court of Bosnia and Herzegovina held today its 167th online plenary session.
Constitutional Court adopted a number of decisions rejecting appeals due to the Court’s lack of jurisdiction to decide, as the 60-day time limit for submitting an appeal had expired, as the appeals were premature given that proceedings on a filed revision or another extraordinary legal remedy were still pending. In addition, the Court rejected the appeals as they were submitted by an unauthorized person (a person without a power of attorney), as the appellant had not exhausted all legal remedies available under the law, as well as for other reasons stipulated under Article 18 of the Rules of the Constitutional Court.
Additionally, the Constitutional Court rendered a high number of decisions rejecting appeals as inadmissible due to being manifestly (prima facie) ill-founded. It implies that there was nothing in the appeal or contested decision indicating that the allegations raised constitutional issues, i.e. nothing indicates that there is a "justified request", within the meaning of Article 18(4) of the Rules of the Constitutional Court, which should be examined on the merits.
At today’s session, a number of requests for the interim measures were also considered and rejected.
All decisions adopted at this plenary session will be published on the website of the Constitutional Court of Bosnia and Herzegovina and communicated to the appellants no later than one month following their adoption.
