141st session of the Grand Chamber

The Constitutional Court of Bosnia and Herzegovina held today the 141st session of the Grand Chamber of the Constitutional Court of Bosnia and Herzegovina by electronic means:

From the decisions adopted today by the Constitutional Court, the following are singled out:

AP 3801/20 - The Constitutional Court concluded that the appellant's right to a fair trial was violated in the case where the Bihać Cantonal Court arbitrarily applied the provision of Article 212 paragraph (3) of the FBiH Criminal Procedure Code because it failed to decide on the entire property claim of the appellant.

AP 1982/21 - The Constitutional Court concluded that in the specific circumstances of the case, by rejecting the appellant's request for registration of ownership over a residential - business building based on the decision of the municipal office (on determining land for regular use) and application form, the appellant was placed under special and excessive burden which led to the violation of the appellant's right to property.

All decisions adopted at today's session will be delivered to the appellants within a month and posted as soon as possible on the website of the Constitutional Court of Bosnia and Herzegovina.
