Constitutional Court’s database contains all decisions, rulings, conclusions and separate opinions (as annex to decisions) adopted during the period from 1996 to present.
Users may search the database by the following categories:
- case number
- date of decision
- type of decision
- appellant’s/applicant’s name/title
- jurisdiction of the Court used in decision-making (category under construction)
- challenged act
- established violation of the Constitution or European Convention (category nder construction)
- key words
- words contained in decisions
Search by case number is the most preferred and prompt search. By entering the case number, all other categories are disregarded and as a result you get the listing of all decisions adopted in that particular case or if the case is joined with another case or its designation was changed, you are presented with the decisions from this case or case with new designation.
Search by words is the most flexible search. Users may search database of decisions by including all the words decision should contain, complete phrase, any word or any combination of these categories.
Considering the importance and complexity of search of decisions by key words here you can view more detailed explanation.
Search by appellant’s/applicant’s name/title or by challenged act is also available. By selecting box on the right-hand side of that category name, the search is activated for that selected category. Initial results may be filtered by entering new category in the search field.
For example, if only part of appellant’s name/title, number of challenged act or adopter of the challenged act is known, you enter this information in the field and click on “Search”. The corresponding results will be listed. By clicking this result you include it as a category for further search of decisions.
You may select one or more types of decisions. When searching for more types of decisions, hold down key “Ctrl” and click on desired type of decision on the list. Deselecting is done in the same way.
You may combine all the abovementioned categories, except for case-number category. For example, it is possible to select type of decision “Decision on Merits” and in the part for text selection request that decisions contain words, for example “European Convention”. This selection will give you only decisions on merits containing words “European” and “Convention”.
Language-selection section contains three official BiH languages, English language and BHS option.
BHS option is for decisions which were not proofread in official languages and are only available in the language requested by the appellant. In general, these are decisions on admissibility and decisions on interim measure. Both the language you chose when you entered the web site and the BHS option are in use all the time while at the web site. You may change this selection during the search.
After selecting one or more categories for search by pressing key “Search” you will be given results corresponding to your criteria. Number of decisions corresponding to your category and currently shown decision will be giving below the results list. By clicking on “<<” or “>>”, you go up or down the list of decisions.
Key “Clear” deselects all previously selected categories.
The results will contain the following information:
- number of case
- appellant’s/applicant’s name/title
- date of decision
- type of decision
In addition to that information, the result will also present links to the summary, INFO and decisions downloads.
